Problems in the Kyiv City QDCB should be resolved through the bar self-government
Overcoming the problems in the work of the Kyiv City Qualification and Disciplinary Commission of the Bar must be resolved through the tools of the bar self-government. This was the commentary given by Mr Yuriy Mykhalskyy, Honored lawyer of Ukraine, candidate of juridical sciences, in an interview to "Legal Practice". On 6 August Mr Mykhalskyy was elected chair of the conference of advocates of Kyiv.
"Unfortunately, the Kyiv City Bar Council, being aware of the problem, did not initiate the conference. Accordingly, the BCU took advantage of its legitimate right to resolve the conflict in the legal field by means of convening the conference. It should be noted that such a precedent emerged for the first time after the enactment of the Law on the Bar. I can assume that the BCU members made it possible for the Kyiv advocates, through the tool of the bar self-government (conference of advocates), to eliminate detected violations directly by themselves, without leading the situation to the courts", - said Mr Mykhalskyy.
He specified that in accordance with part 2 of Article 47 of the Law of Ukraine "On the Bar and Practice of Law", there are three entities authorized to convene a conference of advocates of a region: a regional bar council, 1/10 of the total number of advocates in the region or the BCU.
On 6 August an extraordinary conference of advocates of Kyiv was opened. The conference approved the report of the head of credentials committee, according to which powers of 133 delegates elected from ten districts and of members of the organizing committee were confirmed. The conference will continue its work on 10 September.
"The proposal to make a break was agreed with advocate Zoya Yarosh, Secretary of the conference, and this was done in order to allow the maximum number of the elected delegates to resolve, in the format of a dialogue, the issues of the bar self-government at the conference and to adopt the decision by way of voting, without getting involved in the court litigation", - said Mr Mykhalskyy.
The chairman of the conference explained that the break gives ample time for the conference delegates to carefully study all the materials, to read again and analyze the Law, and to find a way out of the situation.
