E-declarations should not create security threats for declarants - Pavlo Grechkivskyy

The Law "On Prevention of Corruption", pursuant to which the work of electronic declaration system has started, must be changed in the part of publicity of information provided by declarants. This was stated by Mr Pavlo Grechkivskyy, the BCU Secretary, member of the Higher Council of Justice, during his interview to TRC "Ukraine".

"The Law "On Prevention of Corruption" is certainly needed. Worldwide, all states fight against corruption through the adoption of specific laws. Our state also followed this way, but the thing is that Ukraine is the first country in which information about real estate and all valuable personal property was opened in an unprecedented way. Data is available on the internet, and everybody, pursuant to part 1 of Article 47 of the Law, can not only view the information, but also print, copy and use it", - says Mr Grechkivskyy. Under the law, only passport data, identification number and address do not appear online.

The BCU Secretary points to the risk that this information may be used by raiders or robbers, just like in a recent case of robbery of the house of a judge of the Higher Specialized Court. "Burglars can take avenge for any decision of a judge or prosecutor, or indeed any official if he did not do what certain person wanted him to do; they can intimidate any person holding a responsible public office and demand certain decisions by threats. The state should protect those who work for it", - says Mr Grechkivskyy.

These approach-related threats can negate both the purposes of the judicial reform, which envisages minimization of political influence, and the new HR policy after the Maidan, which is aimed at attracting to public administration of people with successful professional experience, including in business.

"To date, these new people come to work with the financial detriment being caused to them; they do not come to work for a clerk’s salary. How many representatives of the Ukrainian diaspora and young people who have created business work today? They are entirely committed persons. If the state demands, also from such people, to fill out a declaration, this is good, but is it really necessary to make public everything", - questions Mr Grechkivskyy.

The BCU Secretary expressed his hope that the law would be amended to provide protection of declarants. "E-declaration is absolutely necessarily, this is a method of fighting corruption, but I am deeply convinced that there is a need to make changes to the publicity of certain sections of a declaration", - said Mr Grechkivskyy. In addition, in his opinion, such changes must also include responsibility for disclosure of the restricted information. In his view, only information about real estate, transport, corporate rights and donations should remain open.
