Changes to the Law on the Bar should be a considered part of the judicial reform
Mr Pavlo Grechkivskyy, the BCU Secretary, commented on the first practical results of the judicial reform, in the framework of which the Laws "On the Higher Council of Justice", "On the Constitutional Court of Ukraine" and amendments to the Law "On the Bar and Practice of Law" are expected to be adopted. As a result of introduction of advocates’ exclusive right to represent clients in courts, the number of advocates is expected to triple, since without the status of an advocate it will be impossible to participate in litigations. It is important to maintain high standards for admission to the profession, to prevent the situation in which accidental or unprepared persons, or lustrated law enforcement officers get into the profession. Rules are certainly set by law, but the selection through exams and traineeships is conducted by the bar self-government, and it is its own responsibility for the standards in the profession", - said Mr Grechkivskyy.
According to him, European experts have concerns about detalization by the law of the issues which can be resolved by the bar self-government. In general, Europeans have always supported self-regulation and independence of the bar.
"The Bar Council of Ukraine as a regulator of the profession is interested in the functioning of the bar self-government bodies in accordance with the specialized law and in granting of access to the profession by legitimate bodies. These goals work for the authority of the Association. A conference of advocates of Kyiv will take place on 10 September, following which the legitimate work of the bar in the capital will be restored. Every advocate’s right to elect his or her colleague, who has the trust and respect, to the bar self-government bodies, in particular to the regional QDCB, is legitimate. I hope that this right will be implemented at the conference as there are no obstacles thereto", - summarized the BCU Secretary.
