By supporting the draft law 9055, people`s deputies shall deprive themselves of the right to protection – Valentyn Hvozdii
The draft law “On the Bar and Practice of Law” No. 9055 constitutes an offence against human rights in Ukraine and carries the risk of losing the features of a rule-of-law state.
This announcement was made by Valentyn Hvozdii, the Deputy Head of the UNBA and the BCU, in the program “Polityka UA” on the parliament TV-channel “Rada”.
"On the eve of the election, it is proposed to deprive people of the right to protection", said Valentyn Hvozdii. The document restricts the professional rights of attorneys and deprives citizens of their constitutional right to legal assistance and the free choice of defence council.
Answering a journalist's question, Valentyn Hvozdii confirmed the thesis that the innovations provided for in the draft law are directly aimed at weakening the position of defense in high-profile or political cases. In particular, the draft law allows an investigator or a judge to engage an attorney from the legal aid system without the consent of the client, and such an attorney will work in parallel with the team of attorneys, chosen by the client.
"This norm will deprive people of the right to protection, but parliament members themselves will also be denied this right. Should this draft law be supported by parliament members, it will boomerang back to them", - said Valentyn Hvozdii.
According to the Deputy Head of the UNBA, the parliament members now understand the consequences of adopting such a draft law and are not ready to support its forced consideration in the Verkhovna Rada.
"Some members of the president's team actually have set him up, having prepared such a wording of law as reformative, but now it seems like parliament members are not going to vote for the draft law 9055 to carry out this situation", - said Valentyn Hvozdii.
The draft law “On the Bar and Practice of Law” No. 9055 was introduced on September 6, 2018 and defined by the President of Ukraine as urgent. An attempt to implement a reform of the Bar was challenged by the professional community.Popular news
