Legal Aid Committee proposes to prohibit legal aid advocates to change the financial terms of work with clients |

The UNBA Legal Aid Committee will initiate changes to the Rules of advocates’ professional conduct in order to prohibit advocates providing legal aid through legal aid centres to conclude contracts with clients for provision of their services on a pay basis. This decision was adopted during the Committee meeting on 12 August. The decision refers to a possible introduction of clarifications to the Rules of advocates’ professional conduct concerning relations between an advocate acting on the basis of assignment made by the legal aid centre and an advocate acting on the basis of concluded agreement. The Committee will also propose the Ministry of Justice to set up a joint working group in accordance with the Memorandum of Cooperation between the MoJ and the UNBA, which would work out the key issues of the legal aid system. In particular, it is proposed that this working group should review the quality standards of work of legal aid advocates, a competitive procedure for the selection of such advocates and their continuous legal training. The working group may include, apart from the MoJ and UNBA representatives, members of NGOs, other government agencies and advocates. |
