The National Police will apply Methodological Recommendations on the Procedure for Reviewing Attorneys' Requests.
On this matter UNBA was informed by Assistant Head of the National Police Igor Klymenko.
Methodological Recommendations are approved for the purpose of avoidance of attorneys' rights violation in advocacy and fulfilment by advocates of national legislation when applying to the National Police and its departments.
A project of Methodological Recommendations was discussed by members of Bar Council of Ukraine during the meeting on the 13th of April 2019 and a working group of the Bar Council of Ukraine, created in February this year, worked on this document. In the project, approved by the decision of Bar Council of Ukraine, contains explanation of "Attorney Request" term and conditions of its reviewing, detailed description of such documents as certificate of right to practice law, both warrant and new type of warrant, which generated online. In Methodological Recommendations reviewed the right of attorney to receive information and documents regarding criminal proceedings prior to Criminal Procedure Code of Ukraine, profile law and the law "On access to public information". A separate section devoted to responsibility for the non-providing of the information to the attorney's request.Popular news
