NAIA students analyzed criminal cases together with an advocate |

The UNBA Committee on Legal Practice organized a meeting for third-year students of the National Academy of Internal Affairs, focusing on the specifics of an advocate’s professional activities and the practical aspects of criminal law. The practical session was led by the Committee’s deputy chairman Volodymyr Martynenko. During the event, the speaker focused on the role of the advocate in the justice system and the status of the UNBA as the sole professional association of advocates, whose activities are regulated by a special law. However, the session was not limited to a discussion of the institutional foundations of advocacy — the students also worked on practical case studies. Future lawyers analyzed criminal law situations together with an advocate — that is, with a representative of the profession who acts as a procedural opponent to investigators, detectives, and operational officers. During the session, students examined tasks related to the classification of criminal offenses against public safety and public order. One of the cases addressed the qualifying characteristics of a criminal organization’s activities and the specifics of holding individuals accountable for participating in such an offense. Another case involved a step-by-step analysis of holding someone accountable for murder. «This training format was interesting for future lawyers because it is useful to view the situation not only from the prosecution’s perspective but also from the defense’s perspective, - commented V. Martinenko on the workshop’s outcomes. - It is the advocate in criminal proceedings who is usually the first to draw attention to weaknesses in the charges, procedural risks, gaps in the evidence, or details that could alter the legal assessment of the incident. Therefore, studying the material from this perspective provides a better understanding of the very standard of a fair trial». However, for some in the audience, this meeting seemed to have another effect as well. During the discussion, several students expressed interest in the legal profession and a desire to join the legal community in the future. |
