The UNBA is developing support measures for businesses affected by the war

Representatives from the business community and advocacy held a working meeting to discuss legal issues related to the documentation and compensation of losses, employee retention, tax and banking issues, access to government support, and the practical enforcement of court decisions.

The event was organized by the UNBA Committee on the protection of victims of armed aggression against Ukraine, compensation mechanisms and European integration legal support for recovery, the Committee on business and investor protection and the Committee on customs and tax law.

Business representatives from various regions participated in the event. Attendees included representatives from industrial enterprises, the agricultural sector, logistics, energy, construction materials manufacturing, medical manufacturing, food processing, consulting, small businesses and business associations.

The meeting participants agreed that the work should focus on specific enterprises, companies, and cases where Russian aggression has destroyed a business or caused it significant harm.

During the discussion, participants noted that existing support mechanisms do not always account for situations where an enterprise or community has suffered a targeted missile or drone strike but does not formally meet the existing criteria for state support. As a result, businesses may be excluded from tax, compensation and other support instruments.

Separately, issues regarding employee retention were raised, particularly for businesses that are effectively operating under challenging security conditions or through structural units in other regions. Business representatives emphasized that personnel issues directly impact the ability to maintain production, preserve jobs and pay taxes.

Discussions also covered difficulties in assessing losses, proving lost profits, interacting with banks, restructuring loan obligations, tax administration, and access to financing. These problems are particularly acute for small and medium-sized businesses, as they often lack sufficient administrative resources for prolonged interaction with government agencies, banks and regulatory bodies.

Meeting participants also discussed the need to study international experience with compensation mechanisms and other tools for protecting businesses from war risks.

Following the event, plans are in place to form a working group that will develop proposals for specific areas and sectors.
