Today, the state lacks effective tools to control the road passenger transportation market. Many services are provided in violation of the law in terms of payment. It is quite difficult to document the flow of money or the regularity of services on a route. To remedy the situation, the UNBA Committee on Transport Law prepared and sent to the State Service of Ukraine for Transport Safety a draft Law «On Amendments to Certain Laws of Ukraine in the Field of Road Passenger Transport». In particular, the document proposes to enshrine in the Law «On Road Transport» the control procurement of services in motor vehicles, which should be carried out by employees of the central executive body that ensures the implementation of state policy on land transport safety. The content of the control procurement is the purchase or consumption of services provided by road passenger carriers, other persons engaged in the transportation of passengers by road, bus stations, and business entities providing commercial intermediation services for the sale of tickets, to verify compliance with the requirements of the road transport legislation by the listed entities. The Procedure for Controlled Procurement of Road Transport Services is expected to be determined by the Cabinet of Ministers after the law is adopted. The authors of the initiative point out that in Ukraine, road passenger transportation services are widely provided by entities that are not registered as business entities, have not obtained a license by law, or do not have the necessary permits to carry out regular passenger transportation. A number of such carriers provide services under the guise of irregular «on-demand» transportation. Some use vehicles with a passenger capacity of no more than 9 people, including the driver. It is noted that an important factor contributing to illegal transportation is the cooperation of shadow carriers with ticket sellers acting as commercial intermediaries (agents, bus stations). The rules for the provision of agency services by bus ticket sellers do not require that the road carrier check whether it has a license or permits for regular transportation. Agency agreements are concluded with all willing carriers. As a result, road carriers that operate in compliance with the law suffer a clear disadvantage. In the presence of an intermediary in the passenger-carrier relationship, it is impossible to establish the commercial purpose of transportation. |
