Efforts to develop advocacy must be brought to fruition — A. Misyats
The Ukrainian advocacy profession is currently going through a critical phase. Amid the war, it must ensure the continuity of legal aid, defend the independence of the profession, and improve qualification and disciplinary procedures in accordance with European standards. The work that has been started must be brought to a practical conclusion.
This was stated by the acting chairman of the Higher Qualification and Disciplinary Commission of the Bar Andriy Misyats, as he explained his decision to relinquish his parliamentary seat
«Parliamentary activity is of great public importance. At the same time, my professional responsibility today is tied to the legal community and the development of bar self-governance», - he noted.
A. Misyats has been serving as acting chairman of the High Qualification and Disciplinary Commission of the Bar since November 15, 2024. «This is a responsible and practical role. The Commission reviews the decisions of regional commissions, ensures consistency in disciplinary practice, and addresses issues that determine the professional status of advocates and, ultimately, the quality of professional legal assistance guaranteed by the Constitution of Ukraine», - he noted.
By law, a parliamentary seat is incompatible with the practice of law. «I have chosen the field in which I have the most experience, specific obligations, and the opportunity to be of service», - explained A. Misyats.
On September 16, the Central Election Commission announced that A. Misyats had submitted a statement renouncing his parliamentary seat. The CEC recognized him as not having assumed the powers of a deputy.
Previously, the CEC had recognized A. Misyats as an elected People’s Deputy.
According to paragraph 5 of part 1 of Article 3 of the Law «On the status of people’s deputies of Ukraine», a People’s Deputy is not permitted to practice law.
