The Scientific and Advisory Board (hereinafter – “SAB”) is a standing advisory body created at the Ukrainian National Bar Association. By its decision of 6 April 2013 no. 119, the Bar Council of Ukraine approved the SAB Regulations and its composition.
The SAB tasks are development of research-based recommendations on issues related to:
- acquisition of the right to practice law, organizational forms of practice of law;
- types of practice of law, advocates’ rights and obligations, professional guarantees;
- suspension and termination of the right to practice law;
- advocates’ disciplinary liability;
- bar self-government and practice of law in Ukraine by foreign advocates.
The SAB aims at promoting the strengthening and development of the institute of the bar in Ukraine. The SAB tasks also include identification of priority areas of research in the field of the bar and practice of law and promotion of advocates’ continuous training.
The SAB has the following functions:
- Providing research-based opinions, recommendations and proposals concerning decisions adopted in accordance with the Law of Ukraine "On the Bar and Practice of Law" on questions of practice of law;
- Consideration of draft decisions, opinions, clarifications etc. issued by the UNBA, BCU on questions arising in the course of practice of law, based on the objectives set out in the SAB Regulations;
- Preliminary consideration of other issues of the UNBA and other bar self-government bodies’ activities, preparation of which requires academic or research support;
- Analysis and examination of jurisprudence in order to increase the effectiveness of practice of law;
- Analysis of international and domestic experience in practice of law;
- Provision of recommendations on issues of legal nature arising in the course of practice of law;
- Provision of opinions on draft legislative acts and on other issues of the bar and practice of law, the preparation of which requires academic and research base;
- Promotion of international cooperation on issues of the bar and law, organization of exchange of relevant research and information materials;
- Participation in the organization and preparation of seminars, academic and practical conferences on topical issues of the bar;
- Participation in the development and examination of proposals concerning the preparation of traineeship programs and advocates’ continuous training;
- Provision, upon instructions of the UNBA/BCU President, of consultative, information and other assistance on matters within its competence.
