Another conflict with the TCC: an advocate's leg was broken and his client jumped out of a window

On June 19, at the premises of the military medical commission, where a bus from the Krasnograd Territorial Center for Recruitment and Social Support delivered several people, an incident occurred involving the use of physical force against an advocate.

According to information from the Kharkiv Regional Bar Association, one of the men, who had been removed from the military register, was being forcibly mobilized in violation of the law. An advocate arrived at the premises to defend the rights of this citizen.

However, while performing his professional duties, the advocate was physically assaulted by TCC employees, resulting in a broken leg, numerous bruises, and hospitalization. After that, TCC employees continued to hold the man, subjecting him to physical and psychological pressure for over 16 hours. As a result of these actions, the man jumped out of a window of the building.

«This is not an isolated case. Impunity and arbitrariness in the system lead to tragedies. Suicide attempts within the walls of the TCC are becoming the new norm. This is not just a violation, it is a system of torture and humiliation that destroys people and trust in the law», - commented the Kharkiv Regional Bar Association on the incident.

According to Article 59 of the Constitution, everyone has the right to professional legal assistance, and this right has not been restricted under martial law, so it must be fully provided by advocates.

The state, in particular the territorial recruitment centers, is obliged to ensure adequate conditions for the practice of law.

This includes providing legal information, advice, and explanations on legal issues, as well as legal support for conscripts. At the same time, the TCC has a duty to guarantee strict compliance with the legal guarantees of the practice of law enshrined in Ukrainian legislation.
