Veterans were provided with algorithms for responding to malfunctions

The UNBA Committee on the protection of victims of armed aggression against Ukraine, compensation mechanisms and European integration legal support for recovery together with the Ministry of Veterans Affairs of Ukraine has prepared the latest Legal Guide for War Veterans.

The fourth edition systematizes the steps to take in cases of denial of status, pension and benefit awards, housing provision, and tax relief, as well as in cases of labor rights violations.

The guide consists of nine chapters. Depending on the issue, each chapter outlines the legal framework, grounds for denial, and the sequence of next steps: obtaining a written, reasoned decision; analyzing the reasons for the denial; compiling evidence; correcting deficiencies in the documents; resubmitting the application; and filing an administrative or judicial appeal.

The first sections are devoted to refusals to grant the status of combatant and person with a war-related disability. The guide explains how to identify the appropriate appeals body, where to file an administrative complaint, and what deadlines to observe. It also addresses specific steps to take in the absence of documentation regarding the circumstances of an injury or when a military medical commission has not properly established a causal link between a wound, concussion, injury, disability or illness and the defense of the homeland.

Two additional procedures concern the denial of the granting and payment of lump-sum financial assistance and a pension due to war-related disability. The publication provides lists of required documents, possible reasons for a negative decision, and ways to obtain the materials on which the decision was based. If deficiencies can be corrected, the publication recommends supplementing the document package and resubmitting the application; if the denial is unfounded, it advises appealing the decision in accordance with established procedures.

Housing Issues cover registration on the housing waiting list and receiving monetary compensation for housing. The publication contains criteria for the need to improve living conditions, a list of required documents for veterans and their family members, rules for preserving the date of the initial application, conditions for awarding compensation, and grounds for denial or deferral of payment. It also describes the steps to take following a positive decision: opening a special account, awaiting the transfer of funds and purchasing housing within six months of the funds being credited.

Other sections address refusals to pay compensation for vehicle modifications, exemptions from land tax and compliance with employment guarantees following discharge from military service. In particular, it lists common mistakes made during vehicle modification and registration, the maximum land plot sizes eligible for tax exemptions, and practical advice on documenting appeals. Labor rights are distinguished for combatants, persons with war-related disabilities, and war veterans; in the event of a violation, it is recommended to sequentially appeal to the employer, the State Labor Service of Ukraine and the court.
