Guarantees for legal practice and FLA – topics of the next meeting of BCU
Today, December 12, marks the start of a two-day meeting of the Bar Council of Ukraine. On the agenda are issues related to the implementation of the advocacy's tasks, improvement of the free legal aid system, the activities of bar self-government bodies, and consideration of requests for clarification.
The meeting is taking place in the village of Plavya, Lviv region.
Among the issues of implementation of tasks, interaction of advocacy with state authorities and other organizations, is the inadmissibility of using materials from covert investigative (search) activities in disciplinary proceedings against an advocate. Members of the BCU will also consider the Roadmap on the rule of law and discuss the legal status of members of bar self-government bodies (disciplinary chambers of the Qualification and Disciplinary Commission of the advocacy) in the context of the submission of declarations by persons authorized to perform state or local self-government functions to the National Agency for Corruption Prevention.
A significant block of issues concerns the state of the free legal aid system:
- improving the procedure for paying remuneration to advocates working in the system;
- amendments to the Criminal Procedure Code and the Law «On Free Legal Aid» regarding the involvement of BVP advocates in certain procedural actions;
- the urgency of providing FLA to military personnel;
- amendments to the Law «On Free Legal Aid» regarding the list of persons entitled to such aid during martial law.
At the meeting, the members of the BCU will also consider the results of the working group on improving the Regulations on the commission for assessing the quality, completeness and timeliness of Free Legal Aid Provided by advocates.
Among the issues related to the activities of the bar self-government bodies, it is planned to approve a new version of the Procedure for ensuring guarantees for the practice of advocate and protecting the professional and social rights of advocates, as well as amendments to the Procedure for improving the professional level of advocates in Ukraine. The BCU will also hear the results of the working group on the implementation of the provisions of the Concept for reforming the procedure for taking the qualification examination to obtain the right to practice as an advocate.
The final part of the meeting will be devoted to considering appeals from advocates and members of the self-government bodies for clarification on practical issues related to the practice of law.
