Students were told about the nuances of the work of a family lawyer
The rights and obligations of brides and grooms, spouses, differences between registered marriage and actual marriage relations, the practice of concluding a marriage contract and the reasons for the low level of agreements in family relations in Ukraine.
Larysa Gretchenko, Chairman of the UNBA Family Law Committee, spoke about these and other issues to law students in Chernivtsi and Lviv.
She conducted seminars «Marriage and Family Relations in the Contemporary Context» for students of the Law Faculty of the Yuriy Fedkovych Chernivtsi National University and «Family Law as a Factor of Personal and Professional Growth of a Future Lawyer» for students of the Institute of Law of the Lviv State University of Internal Affairs.
The lawyer shared her experience in cases of division of spouses' business and property acquired during the family's cohabitation, familiarized with the current challenges and difficulties of resolving disputes on establishing and contesting paternity, and outlined the nuances of exercising the right to inheritance by children.
The students' attention was drawn to the practical aspects of applying liability for violations in the field of family relations. L. Gretchenko highlighted the grounds and consequences of declaring a marriage null and void, depriving one of the spouses of the right to an equal share in the division of property that is the object of the right of joint ownership of the spouses, deprivation of parental rights, deprivation of the right to be an adoptive parent, guardian or trustee, removal of a child from parents without deprivation of their parental rights, recovery of a penalty for late payment of alimony, invalidation/cancellation of adoption, etc.
The UNBA Committee Chair and law students also exchanged views on the role of a family and child protection lawyer, the practice of providing legal aid based on the principle of the best interests of the child, the benefits of family mediation, and the importance of negotiation and agreement skills.
«The views of modern youth on marriage and family are quite different. Since family relationships are built on emotional closeness, feelings of love, trust and mutual responsibility, one of the most pressing problems today is the instability of marriages and the massive nature of divorces. The personal and professional interest of future lawyers includes both knowledge of family law and procedural levers of influence, as well as mediation and other methods of alternative dispute resolution, which allows them to use time rationally, avoid delays, not turn participants in family relationships into rivals and maintain non-conflict communication in the future», - commented L. Gretchenko.
