A Register of Administrative Proceedings on Lawyers' Complaints to Be Established in Ukraine
All cases of unlawful refusal to provide information at the request of lawyers, the requests of the QDCB, their chambers or members will be recorded in the Register of applications (appeals) on administrative offenses. The relevant terms of reference have already been submitted to the IT service for implementation.
This was announced during a meeting of the Bar Council of Ukraine, which is taking place today in Zakarpattia, by Valentyn Gvozdiy, the Vice President of the UNBA, BCU.
He thanked the Chairman of the UNBA Committee on Prevention of Administrative Offenses Committed Against Advocates, Serhiy Osyka, who initiated and launched the project.
It should be reminded that unlawful refusal to provide information, untimely or incomplete provision of information, provision of information that is not true in response to a lawyer's request, a request of the Qualification and Disciplinary Commission of the Bar, its chamber or member in accordance with the Law of Ukraine «On the Bar and Practice of Law» is an administrative offense, liability for which is provided for in Art. 212-3 (Violation of the right to information and the right to appeal) of the Code of Administrative Offenses.
V. Gvozdiy said that access to the register of applications for such administrative offenses is planned to be provided to all bar councils in the regions, which will track all complaints, violators, court cases, etc. This database will be useful for those chairmen and members of the councils who are authorized to draw up reports on offenses.

The working group on the implementation of the Roadmap on the rule of law in the area of advocacy will operate at several levels: plenary meetings as a platform for adopting framework decisions, a coordination bureau for compiling documents and calendar control, and thematic subgroups for preparing norms and their justification. International experts will verify the results against European standards and «red lines».

The Roadmap on the Rule of Law is not a basis for restructuring the model of advocacy, but a framework for verifying and improving the already European-oriented system. At the same time, part of the work has already been done, so further progress should be made in the form of coordinated and practical decisions.
