In the IV quarter of 2020, 47 searches of attorneys took place, majorly in Kyiv

In the IV quarter of 2020, 47 authorized searches and detentions against attorneys all over Ukraine have taken place. Kyiv Bar Council received the largest number of official notifications on proceedings against attorneys, namely –12 notifications. Dnipropetrovsk Bar Council took second place by receiving 7 of such notifications. Volyn region took third place by receiving 6 of such notifications.
This information is based on the statistics on the activities of bar self-government bodies published on the Ukrainian National Bar Association (hereinafter – the “UNBA”) website.
During the IV quarter, the regional Bar Councils made 60 visits to searches and detentions against attorneys, including 12 visits made by the Kyiv and Kyiv Region Bar Councils each. 9 visits were recorded in Volyn.
At the same time, 12 searches and detentions against attorneys have taken place across the country without notifying the regional Bar Councils which breaches the Law of Ukraine “On the Bar and Legal Practice”. 8 out of 12 of such cases occurred in the Kyiv region.
According to statistics, in October-December 2020 the regional Bar Councils received 376 requests from attorneys regarding the refusal to provide information at the request of an attorney. The record number of such requests was received Kyiv region, namely 104 of such requests. Kyiv Bar Council received 84 of such requests, Dnipropetrovsk region took third place where regional Bar Council received 32 requests from attorneys regarding this type of violation of professional right. 30 protocols concluded upon the fact of refusal to respond to the attorney's request were satisfied by courts. In regions, 8 protocols were satisfied in Kyiv and Zaporizhia regions, and 5 protocols were satisfied in the Odesa region.
In the IV quarter of last year, regional Bar Councils received 24 complaints regarding the violations of attorneys’ bar rights and guarantees. During this period, the Bar Council of Ukraine received 29 complaints from attorneys regarding the violations of rights while 16 of them were sent to law enforcement agencies and 28 of them were sent to the relevant Committee of UNBA for further processing.
