The status of implementation of electronic document management in enforcement proceedings was discussed at the UNBA
Obtaining enforcement documents in the Electronic Court, initiating proceedings on the basis of an electronic document, and exchanging materials in electronic form were the key topics of the professional discussion «Digitization of enforcement proceedings: problems and prospects».
The event, organized by the Ukrainian National Bar Association, was attended by advocates, representatives of the State Enterprise Information Court Systems, the State Enterprise National Information Systems, the Ministry of Justice, and the Association of Private Enforcement Officers of Ukraine.
Oleksandr Chornobai, Deputy director of the State Enforcement Service Department of the Ministry of Justice, reported that today, about 19,000 enforcement documents have already been submitted in electronic form. According to him, digitization remains one of the priority areas for the development of enforcement proceedings, and therefore legal education measures for the population on the possibilities of using electronic enforcement documents are important.
Modern technologies help reduce the amount of daily work for lawyers, including in the field of enforcement proceedings, according to Andriy Avtorgov, private enforcement officer. He noted that the opening and completion of proceedings, the delivery of documents, the search for information about the debtor's property, and the seizure of funds have already been transferred or are being transferred to the digital space to one degree or another. Not so long ago, it became possible to submit enforcement documents issued by courts in the form of electronic documents for compulsory enforcement. And despite technical problems, electronic enforcement documents are more convenient for the claimant. There is no risk of them being lost in the mail, no need for duplicates, and no risk of forged enforcement documents being presented for enforcement.
Despite the fact that more than a year has passed since the introduction of the section on enforcement documents in the Electronic Court, there are still many questions about the system, noted Tetyana Rabko, Deputy chairman of the UNBA Committee on Electronic Justice and Cyber Security in the Legal Profession. She emphasized that the applicant can contact a state or private enforcement officer with a request for the status of the proceedings via email, provided that a qualified electronic signature is used. According to her, enforcement officers promptly consider such requests and provide responses also in electronic form. All technical capabilities for electronic document exchange exist — the main thing is to use them correctly.
Summing up the event, Oleksandr Chernykh, the chairman of the UNBA Committee on Enforcement of Decisions, emphasized that the digitization of enforcement proceedings is a process that requires constant improvement. «The Ukrainian system is one of the most advanced in the world, but we still have room for improvement, and such events, involving all stakeholders, are important for developing practical solutions and exchanging views», - he concluded.

On June 9, the Verkhovna Rada Committee on legal policy held a working meeting to prepare for the ratification of the Council of Europe Convention on the Protection of the Professions of Lawyer.
